Terms of Service

1. Acceptance of Terms

By accessing or using mepersona.ai, operated by MePersona, Inc. ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the platform.

2. Eligibility

You must be at least 18 years old to use mepersona.ai. By creating an account, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement.

3. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate and complete information during registration and to update it as necessary.

4. Platform Services

mepersona.ai provides the following services:

• Unified messaging inbox aggregating fan communications from connected social platforms
• AI-powered response generation trained on your personality and communication style
• Platform connection management via OAuth and API integrations
• Analytics and engagement tracking across connected platforms

5. Connected Platforms

When you connect third-party platforms (Instagram, X/Twitter, YouTube, etc.), you authorize us to access your account data as permitted by each platform's API and your granted permissions. You are responsible for complying with each platform's terms of service. We are not responsible for any actions taken by third-party platforms regarding your account.

6. AI-Generated Content

mepersona.ai uses artificial intelligence to generate suggested responses to fan messages. You acknowledge that AI-generated content may not always be accurate or appropriate. By default, you review, edit, and approve AI-generated responses before they are sent. If you choose to turn on auto-reply, you authorize mepersona.ai to send eligible AI-generated responses on your behalf without reviewing each one individually. You can turn auto-reply off at any time. You are solely responsible for all responses sent from your connected accounts, whether you approved them individually or they were sent by auto-reply. We are not liable for any consequences arising from AI-generated content.

7. Subscription & Payments

mepersona.ai offers both a Free tier and paid subscription tiers (Premium, Pro, Pro Elite, and Enterprise). Paid subscriptions are processed through Stripe and renew automatically unless canceled before the renewal date. Refunds are handled in accordance with our refund policy. We reserve the right to change pricing with reasonable notice. The Free tier does not require a payment method but is subject to the additional terms set forth in Section 7A below.

7A. Free Tier: Data Use

The Free tier is offered at no monetary cost. Free tier accounts are subject to the same data protections as paid accounts. This section describes how we handle your data.

• License to operate the service. You grant MePersona, Inc. a limited, non-exclusive, royalty-free license to host, store, process, and display the content you submit or connect, solely to provide and improve the service to you. You retain ownership of your content.
• No sale or sharing of personal information. We do not sell, share, rent, license, or otherwise disclose your personal information, as those terms are defined under the CCPA/CPRA and similar laws, to data brokers, advertisers, researchers, or any other third party for their own purposes.
• Service providers. We disclose data to vendors who process it on our behalf to run the platform, including hosting, payment processing, and AI model providers. They act under contract, may process data only to deliver the service to us, and may not use it for their own purposes.
• Model training. We do not use your content to train third-party foundation models. We use your edits and corrections to improve your own persona, and aggregated de-identified statistics to improve the product.
• Fan and third-party data. Messages and comments from your fans are processed solely to provide the service to you. We do not monetize them. You represent that you have the rights necessary to connect the accounts from which those messages are ingested.

These terms apply equally to Free and paid accounts. We do not sell or share personal information of any user for cross-context behavioral advertising or data monetization.

7B. Refunds

If you are not satisfied with a paid MePersona subscription, you may request a full refund of your first payment within 30 days of that payment by emailing support@mepersona.ai. Refunds apply to subscription fees only. One-time message top-ups are non-refundable once any purchased messages have been used.

8. Acceptable Use

You agree not to:

• Use the platform for any unlawful purpose or in violation of any applicable laws
• Attempt to reverse-engineer, decompile, or extract source code from the platform
• Use the platform to harass, spam, or send abusive messages
• Share your account credentials with third parties
• Circumvent any security features or access controls
• Use the platform to distribute malware or harmful content

9. Intellectual Property

All content, features, and functionality of mepersona.ai (excluding user-generated content) are owned by MePersona, Inc. and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of your content but grant us a limited license to process it as needed to provide our services.

10. Limitation of Liability

To the maximum extent permitted by law, MePersona, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of mepersona.ai, including but not limited to loss of revenue, data, or business opportunities. Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Disclaimer of Warranties

mepersona.ai is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Termination

We may suspend or terminate your access to mepersona.ai at any time for violation of these terms or for any other reason at our sole discretion. You may cancel your account at any time. Upon termination, your right to use the platform ceases immediately.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in California.

13A. Language

These Terms are written in English. If we provide a translation of these Terms or any related policy, it is for convenience only, and the English version controls if there is any conflict.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated terms on this page. Continued use of the platform after changes constitutes acceptance of the revised terms.
